Price Appeal Ready For Argument
Before Illinois Supreme Court
NEW YORK (October 4, 2004) - Philip Morris USA today filed its final legal brief in connection with the appeal of a $10.1 billion judgment in its appeal of the Price judgment.
The Court has not yet set a date for the argument, but the company expects it will soon be scheduled.
"Philip Morris USA looks forward to the opportunity to convince the Illinois Supreme Court that this case should never have been certified as a class action, and that the judgment is inconsistent with the facts presented at trial and with Illinois law. The company believes that the Madison County court's decision should be overturned," said William S. Ohlemeyer, Philip Morris USA vice president and associate general counsel.
